3:26-cv-01511-MAS-RLS
Links To Filed Court Documents Below

The case — Mitchell v. Davenport — has now been expanded through a First Amended Complaint and Preliminary Injunction Brief, raising multiple constitutional challenges to what the filings describe as a system that criminalizes silence, paperwork omissions, and compelled firearm surrender during routine encounters.

This case goes far beyond a typical Second Amendment challenge. It raises seven separate constitutional claims, including:
Second Amendment (Bruen Framework), First Amendment (Compelled Speech), Fourth Amendment (Unreasonable Seizure), Fourteenth Amendment (Due Process), Equal Protection, Supremacy Clause (FOPA Preemption under 18 U.S.C. § 926A).

Federal Filings:
001 - First Amended Complaint
002 - First Amended Preliminary Injunction Brief
